Im Mai 2017 jährt sich zum 50. Mal die Entscheidung des US Supreme Courts im Immigrationsfall des Kanadiers Boutilier (gegen die US-Einwanderungsbehörde).

Grund der verweigerten Einwanderung (und Grund für die Ausweisung) war die Homosexualität Boutiliers. Der Fall ging dann bis vor das (höchste) US-Bundesgericht.
Dieses prüfte den Ausweisungsgrund auf Grundlage der bestehenden Gesetze, nach denen Personen mit "psychopathischen Zügen" die Einbürgerung verwehrt werden konnte.
"The petitioner, an alien, has been ordered deported to Canada as one who upon entry into this country was a homosexual and therefore "afflicted with psychopathic personality" and excludable under § 212(a)(4) of the Immigration and Nationality Act of 1952, 66 Stat. 182, 8 U.S.C. § 1182(a)(4). "
Der Streit ging dann darum - vor nur 5 Dekaden - ob Homosexuellen psychopathischen Defekten unterliegen.
Auch Gegenstimmen von Gutachtern gab es: "I do not believe that Mr. Boutilier is a psychopath."
Für die Ausweisung nützte das nichts mehr. In den US-Medien wird dieser Tage an den Jahrestag der Entscheidung erinnert:
"The Supreme Court, however, ruled 6-3 against Boutilier. Justice Tom Clark’s majority opinion rejected much of the medical testimony by noting that “Congress used the phrase ‘psychopathic personality’ not in the clinical sense, but to effectuate its purpose to exclude from entry all homosexuals and other sex perverts.”

"The American Psychiatric Association declassified homosexuality as a mental illness in 1973, but Congress did not eliminate the “psychopathic personality” provision in U.S. immigration law until 1990. Boutilier died in a home for people with disabilities in 2003, two months before the U.S. Supreme Court overturned state sodomy laws in Lawrence v. Texas"
